Practitioner Listing Agreement

This agreement ("Agreement") is between you ("the Practitioner") and Illuminated Thinking Ltd ("the Directory", "we", "us"), operating glasgowtherapists.com. By creating an account and listing your profile, you agree to the following terms.

1. Your listing

1.1 Profile content

You are responsible for ensuring that all information in your profile is:

  • Accurate, truthful, and not misleading.
  • Up to date. You should review and update your profile whenever your circumstances change (including fees, availability, specialisms, and registration status).
  • Professional and appropriate. Profile content must not contain discriminatory language, make unsubstantiated clinical claims, or breach any professional code of conduct.

1.2 Professional credentials

You must accurately represent your qualifications and professional registrations. Claiming a registration or qualification you do not hold is a material breach of this Agreement and may constitute a criminal offence under UK law.

Where your profession requires registration with a statutory regulator (such as the HCPC for psychologists), you must maintain that registration throughout the period of your listing. You must notify us immediately if your registration is suspended, revoked, or subject to conditions.

1.3 Insurance

You must hold appropriate professional indemnity insurance covering the services you advertise for the duration of your listing. We may request evidence of insurance at any time.

2. Subscription and payment

2.1 Paid listings

  • Subscriptions are billed monthly via Stripe on the anniversary of your sign-up date.
  • All new subscriptions include a 14-day free trial. Your card will not be charged during the trial period. You may cancel before the trial ends without charge.
  • Current subscription plans: Basic Listing (£5/month) and Featured Listing (£9/month).
  • We may change subscription prices with 30 days' written notice. Existing subscribers will be given the option to cancel before the new price takes effect.

2.2 Complimentary listings

We may offer complimentary (free) listings at our discretion, for example to practitioners renting clinical rooms at our premises. Complimentary listings:

  • Are provided on a goodwill basis and do not constitute a contractual entitlement.
  • May be withdrawn with 30 days' written notice.
  • Are subject to the same profile and conduct requirements as paid listings.

2.3 Cancellation

You may cancel your listing at any time by cancelling your subscription through the dashboard or by contacting us. Upon cancellation:

  • Your profile will remain visible until the end of the current billing period.
  • After the billing period ends, your profile will be hidden from the directory.
  • Your account data will be retained for 30 days, then deleted. You may request immediate deletion by contacting us.

3. Your obligations

3.1 Professional conduct

You agree to:

  • Conduct yourself in accordance with the ethical code of your professional body.
  • Respond to client enquiries received through the directory in a timely, courteous, and professional manner.
  • Not use the directory to advertise services that fall outside your competence or training.
  • Comply with all applicable UK law, including but not limited to the Equality Act 2010, UK GDPR, and relevant healthcare regulations.

3.2 Data protection

When you receive enquiry data (names, email addresses, phone numbers) through the directory, you become a data controller for that data under UK GDPR. You must:

  • Process enquiry data only for the purpose of responding to the enquiry.
  • Not add enquirers to marketing lists without their separate, explicit consent.
  • Store and dispose of enquiry data securely.
  • Be registered with the ICO if required by your data processing activities.

4. Our rights

4.1 Moderation

We reserve the right to edit, suspend, or remove your listing if it breaches this Agreement, contains inaccurate information, or following a substantiated complaint. We will notify you by email and, where practicable, give you an opportunity to address the issue before removal.

4.2 Use of your content

You grant us a non-exclusive, royalty-free licence to display your profile content (name, photograph, biography, credentials, and related information) on the directory and in associated promotional materials (such as social media) for the duration of your listing. This licence terminates when your listing is removed.

5. Complaints

If we receive a complaint about your conduct or services from a member of the public, we will:

  1. Notify you of the complaint in writing.
  2. Give you a reasonable opportunity to respond (typically 14 days).
  3. If the complaint relates to a breach of your professional code, we may refer it to your professional body.
  4. If the complaint is substantiated and unresolved, we may suspend or remove your listing.

6. Limitation of liability

We provide the directory platform on an "as is" basis. We do not guarantee that the directory will generate any particular volume of enquiries or clients. Our liability is limited as set out in our Terms of Service.

7. Governing law

This Agreement is governed by the laws of Scotland. Disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
